Judge Rejects Trump “Absurd” Rape Lawsuit Dismissal: Reuters: NEW YORK A U.S. judge on Friday rejected former president Donald Trump’s attempt to have the lawsuit against him for defamation and battery after he denied raping writer E. Jean Carroll in the mid-1990s as “absurd.”

According to U.S. District Judge Lewis Kaplan in Manhattan, Trump’s allegation that Carroll’s battery suit under the Adult Survivors Act in New York must be rejected because the legislation violated his right to due process under the state’s constitution is without substance.

The judge also ruled against Trump’s argument that Carroll, a former Elle magazine columnist, was required by state law to demonstrate that she had suffered a financial loss as a result of his remarks.

Trump’s attorney Alina Habba declared, “We are upset with the court’s judgement,” and announced that an appeal would be filed right away. Roberta Kaplan, Carroll’s attorney, stated that while “we are delighted but not surprised” by the ruling.

One of two lawsuits in which Carroll accuses Trump of defamation stemming from his denial of raping her in a Bergdorf Goodman department store dressing room in late 1995 or early 1996, according to the complaint.

Trump initially denied the allegation in June 2019, telling a reporter at the White House that he did not know Carroll, that “she’s not my type,” and that she made up the incident to promote her new novel. Carroll then filed a lawsuit against Trump.

In a social media post dated October 2022, Trump termed the rape claim a “hoax,” “fraud,” “con job,” and “total scam,” adding that “this can only happen to ‘Trump’!” This led to the second lawsuit.
